This website, halden1980.shop, is operated by Calbourne Holdings LLC under the brand HALDEN ("we", "us", "our"). The store runs on Shopify. These Terms of Service, together with the policies they refer to — our Privacy Policy, Shipping Policy, Return and Refund Policy and Payment Policy — govern your use of the store and any purchase you make. By using the store or placing an order you agree to these Terms. If you do not agree, please do not use the store.

1. Eligibility and Accounts

You must be at least the age of majority where you live to place an order. Information you provide at checkout or in your account must be accurate, current and complete. You are responsible for keeping your login credentials secure and for activity on your account.

2. Products

We aim to describe and display every product accurately. Colours and finishes may look slightly different on your screen, and some lifestyle images are styled for presentation; the written specifications on each product page prevail. Products and descriptions may change and may be discontinued at any time, and we may limit quantities per customer or region.

3. Orders

Placing an order is an offer to buy. Your order is accepted when we confirm it by email after payment has been received. We may decline or cancel an order — for example because of stock, a pricing error or suspected fraud — and in that case any payment taken is refunded in full. Products are sold for personal use, not for resale.

4. Prices, Payment and Taxes

Prices are shown in USD unless your local currency is displayed, and may change without notice; the price that applies is the one shown when you order. Sales tax is calculated at checkout where applicable. International import duties and taxes are handled as described in our Shipping Policy. Payment terms are set out in our Payment Policy.

5. Shipping and Delivery

Processing and delivery times are estimates, described in our Shipping Policy. Risk of loss passes to you when the product is delivered to the address provided at checkout.

6. Returns and Refunds

Returns, exchanges, cancellations and refunds are handled under our Return and Refund Policy, which forms part of these Terms. Customers in the EU, EEA and UK also have the statutory rights described on our Cancel Contract page.

7. Intellectual Property

The store's content — including the HALDEN name and logo, text, images, graphics and design — belongs to Calbourne Holdings LLC or its licensors and is protected by intellectual property laws. You may use the store for personal, non-commercial shopping only. Other names and marks shown belong to their respective owners.

The store may include tools or links provided by third parties. They are offered "as is", we do not control them, and your use of them is governed by the third party's own terms.

9. Relationship with Shopify

Purchases made in this store are made directly with Calbourne Holdings LLC. Shopify provides the platform but is not a party to the sale and is not responsible for the products or for any issue arising from your purchase.

10. Reviews and Feedback

If you submit a review, comment or suggestion, you confirm it is honest and your own, and you grant us a free, worldwide, perpetual licence to use, reproduce and display it in connection with the store. We may remove content that is unlawful, offensive or misleading.

11. Errors and Inaccuracies

The store may occasionally contain errors in descriptions, prices, promotions, shipping costs or availability. We may correct them at any time and, where an order was placed at a clearly wrong price, cancel it and refund any payment taken.

12. Prohibited Uses

You may not use the store for any unlawful purpose; to infringe intellectual property or privacy rights; to submit false information or impersonate others; to place fraudulent orders or file knowingly false claims or payment disputes; to upload malicious code; or to scrape, copy or interfere with the store or its security. This does not affect any warranty or guarantee that cannot be excluded under the consumer law of your country.

14. Limitation of Liability

To the fullest extent permitted by law, Calbourne Holdings LLC, its owners, employees and service providers are not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the store or products purchased through it. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnification

You agree to indemnify and hold harmless Calbourne Holdings LLC and its service providers from third-party claims, losses and reasonable legal fees arising from your breach of these Terms or your misuse of the store.

16. Resolving Problems

If there is a problem with an order, please contact us first at support@halden1980.com. Most issues are resolved quickly and directly with our support team, faster than through a bank or card dispute.

17. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, and disputes are subject to the state and federal courts located in the State of Florida. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

18. General

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the policies they refer to are the entire agreement between you and us about the store. We may transfer our rights under these Terms; you may not transfer yours without our consent. Headings are for convenience only.

We may update these Terms from time to time. The version posted on this page, with its "Last updated" date, applies to orders placed from that date.
